Legal issues in film industry

Within the fifth Congress of IAB (Independent Association of Radio & TV broadcasters): «All modern aspects of radio and  television activities» head of legal department of FILM.UA , Igor Bondarenko,  made a speech. On May 23, at 17:00, Igor along with representatives from the Ministry of Culture of Ukraine and the STB have taken part in a panel discussion on «Intellectual Property: distribution of film rights».

In Ukraine, not so long ago, laws were adopted that govern the relationship between the parties in the purchase / transfer of intellectual property rights, and now it is important that these laws were built into a single, integrated system, which would also allow the industry to work in film and television production, without complicating already complicated processes, and protect the author's right to transfer their ideas, scripts and other results of intellectual work.

In general, the film industry, where inspiration and creativity reign, faces the issues of development of  legislation basis that would allow convenient working conditions for all parties (filming, distribution, adaptation and transmission of audiovisual content). One of the issues that have been discussed  recently was the taxation of the film industry. It is known that in 2010 there have been several legislative proposals that simplify taxation for the film industry in Ukraine. And a few days ago there was a round table with participation of representatives of the Film Market and the State Tax Service.

In the discussion participated chief lawyer of FILM.UA Group, Eugeniya Derbal. According to Eugeniya, due to such activities it is possible to identify «white spots»  in existing legislation. «There was a question about what is to be considered under a «national film», what services / works can be attributed to the production of national film and are exempt from VAT and income tax? It was decided to approve all of these services in a special decree of the Cabinet of Ministers. For their part filmmakers will submit their proposals».
